Terms of service
Updated 28 September 2026.
Who we are
Tendersmith is provided by ZLT Contractors Ltd (company number 13997354, registered office c/o Hawkins Accounts Ltd, Unit 10 Saxon House, Upminster Trading Park, Warley Street, Upminster RM14 3PJ, VAT number GB 449284558), trading as Tendersmith. Contact [email protected]. The service is for businesses acting in the course of their business, not for consumers. By creating an account you confirm you are authorised to accept these terms for your company.
What the service does
Tendersmith helps building compliance and property services contractors find public tenders, understand buyer packs and prepare tender responses. AI features produce reviews, drafts, price workings and checks from the documents and records you provide. You decide what to bid for, check and approve every answer and price, and submit through the buyer’s own process. Tendersmith does not submit bids, confirm your eligibility or compliance, or guarantee any score or contract award.
Not legal, financial or pricing advice
- Contract risk and tender review: summaries of contract terms, risks and questions for the buyer are explanations to help you decide. They are not legal advice. Take advice from a solicitor on terms that matter to you.
- Pricing: market rates, task times, bills of quantities, scenarios and filled price schedules are workings built from published rates and your own inputs. They are not financial or pricing advice. You are responsible for your prices, your margins and for checking every figure before you submit.
- Evaluator-view score: any score or grade the service shows is an estimate of how an evaluator might mark the text against the buyer’s published criteria or our benchmark. It is not a prediction of your result, and buyers mark differently.
Plans, trial and allowances
The free trial lasts 14 days from email verification, needs no card and does not turn into a paid plan automatically. If you do not subscribe, we keep the trial account and its data for 90 days after the trial ends and then delete it; we email you 14 days before deletion. Scout costs £99 a month and Builder £249 a month, both excluding VAT, which is added at 20% (£118.80 and £298.80 a month including VAT), each for one company workspace with one owner login. Each plan includes an allowance of bids, shown on your Plan & allowance page: the free trial includes 1, Scout 3 a month and Builder 10 a month. A bid is counted when you start the first AI step on a tender; every later AI step for that tender is included, subject to a fair-use limit of 120 AI steps per bid. Changes you ask for with Ask for changes are included subject to a separate fair-use limit. Unused bids do not roll over.
Monthly AI limit. Each account also has a monthly limit on AI spending, shown on your Plan & allowance page, which protects you and the service from runaway costs. Large tenders with many scored questions use much more AI than small ones, so an account working on large tenders can reach this limit before it has used all of its bids. When it does, new AI steps pause until the next period and your work is kept; contact us and we will tell you your options. A step that repeats unchanged inputs reuses the earlier result at no cost. Large buyer packs may need splitting within the published upload limits. A step whose outcome is uncertain is not repeated automatically.
Promotional offers (such as founding-customer pricing) have their own published terms, which apply alongside these terms.
Billing and cancellation
A paid plan starts once payment is confirmed and renews monthly until cancelled. You can cancel renewal from the billing portal and keep your paid allowance until the end of the period already paid for. Payments are non-refundable except where an offer says otherwise or the law requires. Failed payments can pause new AI work. When a plan ends you can still read and download existing work until you close your account or, for a trial, until it is deleted as described above. We will give at least 30 days’ notice by email of any price change for your plan.
Your responsibilities
Keep your login private and tell us straight away if you think it has been misused. Only upload documents and personal data you are authorised to use. Check every AI output: dates, figures, standards, claims, prices, named partners and buyer instructions. A draft that reads well is not evidence that its claims are true, and every placeholder ([CONFIRM] or [EVIDENCE NEEDED]) must be resolved by you before you submit. You are responsible for everything you submit to a buyer.
Acceptable use
You must not use Tendersmith to:
- make statements to a buyer you know or suspect to be false, such as accreditations, certificates, staff, partners or experience you do not have, or collude with other bidders;
- upload material you have no right to use, including another bidder’s confidential documents, or security-classified or UK-only material;
- upload malware, or try to break, probe, overload or get around the service’s security, limits or allowances;
- share your login, resell the service or run it for other companies without our written agreement;
- scrape the service or use it to build a competing product;
- use it for anything unlawful, including sending unsolicited marketing in breach of the Privacy and Electronic Communications Regulations.
We may suspend an account that breaks these rules, is compromised or puts the service at risk. We will tell you why unless the law or security prevents it.
AI processing
AI features are provided through OpenRouter, Inc. (United States). Drafting, reviews and checks use Claude models developed by Anthropic, sent first to hosts in Europe (Google Cloud Vertex AI in Europe, then Amazon Bedrock in Ireland); reading and extraction steps use models developed by Xiaomi (MiMo) and, as a stand-by, MiniMax. Requests go only to hosts listed as zero data retention, with data collection for training denied, and your content is not used to train AI models. Hosts can be outside the UK, including in the EU, the United States and China. The privacy notice has the detail. We may change the models or hosts we use to keep the service working and will update the privacy notice when we do. AI output is a draft for your review; it can be wrong, and it is not legal, financial, pricing or professional advice.
Your content
You own your content: the documents and records you upload, the information you enter, and the drafts, analyses and other outputs produced for you in your workspace. You give us only the limited, non-exclusive licence we need to host, store, copy, process and transmit that content to provide the service to you (including sending it to our sub-processors for the AI steps you start), for as long as your account is open and as described in the privacy notice. We do not use your content to train AI models, and we do not share it with or show it to other customers. You are responsible for having the rights to the content you upload. The Tendersmith software, templates, knowledge packs and designs remain ours.
Data protection: when we process personal data for you
Where your content includes personal data (for example staff CVs or referee details), you are the controller and we are your processor. We will: process it only to provide the service and on your documented instructions (these terms and your use of the service); make sure our staff are bound by confidentiality; keep appropriate security measures; use only the sub-processors named in the privacy notice, each bound by data protection terms, and give notice of changes through the privacy notice so you can object; help you answer requests from individuals and meet your security, breach and impact-assessment duties; tell you without undue delay after we become aware of a personal data breach affecting your data; delete your data when your account is closed or deleted (backups expire within 30 days); and give you the information you reasonably need to show compliance.
Availability and data sources
Tender search uses notices collected from Contracts Finder and Find a Tender and does not cover every portal or every attachment. Government feeds and AI providers can be unavailable, slow or incomplete, and the service may be paused for maintenance. We aim to keep it available but do not guarantee it at any particular time, including close to a tender deadline: leave yourself time.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot lawfully be limited. Otherwise, we are not liable for lost contracts, lost profits, lost revenue or indirect losses, and our total liability in any 12-month period is limited to the fees you paid us in that period.
Changes, ending and law
We may update these terms and will email account holders at least 30 days before a change that affects them materially takes effect. You can export your data and close your account from Account & security at any time. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
